If you are below the age at which you may legally agree to contractual terms in your jurisdiction, you should use the Services only with appropriate parental or guardian involvement.

5. EDITORIAL AND INFORMATIONAL NATURE OF THE SERVICES

BizJet Journal is primarily a media, publishing, research, and information service.

Unless expressly stated otherwise in a separate written agreement, information appearing on BizJet Journal is provided for general informational, journalistic, research, and educational purposes.

Publication of information does not create a professional, advisory, brokerage, fiduciary, agency, operator, consultant, or client relationship between you and BizJet Journal.

6. BIZJET JOURNAL IS NOT AN AIRCRAFT OPERATOR

BizJet Journal is not, merely by publishing aviation content:

  • an aircraft operator;
  • airline;
  • air carrier;
  • charter operator;
  • flight department;
  • aircraft management company;
  • FBO;
  • airport operator;
  • ground handling company;
  • maintenance organization;
  • flight planning company;
  • aviation regulator; or
  • air traffic services provider.

References to operators, aircraft, charter companies, airports, FBOs, or aviation services do not mean that BizJet Journal operates, controls, certifies, manages, or supervises those services.

7. BIZJET JOURNAL IS NOT A CHARTER BROKER

Unless a specific service is separately and expressly identified as being provided by another properly disclosed entity, BizJet Journal does not act as a charter broker merely because the website publishes:

  • charter pricing information;
  • private jet comparisons;
  • charter market data;
  • route analyses;
  • charter guides;
  • operator profiles;
  • aircraft availability information; or
  • information concerning private aircraft travel.

No article, database entry, advertisement, directory listing, or editorial feature constitutes an offer by BizJet Journal to arrange air transportation.

8. NO AVIATION OPERATIONAL ADVICE

Information published by BizJet Journal must not be used as the sole source for safety-critical or operational aviation decisions.

This includes decisions concerning:

  • flight planning;
  • dispatch;
  • navigation;
  • aircraft performance;
  • fuel planning;
  • weather;
  • NOTAMs;
  • airport suitability;
  • runway performance;
  • takeoff or landing calculations;
  • aircraft weight and balance;
  • maintenance;
  • airworthiness;
  • crew qualifications;
  • duty limitations;
  • operating approvals;
  • landing permits;
  • overflight permits;
  • customs;
  • immigration;
  • sanctions;
  • security procedures;
  • regulatory compliance; or
  • emergency operations.

Operational information should always be verified through appropriate official, regulatory, operator, manufacturer, airport, meteorological, navigation, or other authoritative sources before being relied upon.

BizJet Journal is not a substitute for approved aviation documentation, an aircraft flight manual, operator procedures, regulatory publications, NOTAM systems, navigation databases, dispatch services, or professional aviation advice.

9. AIRCRAFT SPECIFICATIONS

BizJet Journal may publish specifications for private jets, business aircraft, helicopters, VIP airliners, or other aircraft.

Specifications may include:

  • range;
  • maximum takeoff weight;
  • cabin dimensions;
  • baggage capacity;
  • passenger capacity;
  • cruise speed;
  • maximum altitude;
  • runway requirements;
  • engine information;
  • fuel capacity;
  • cabin altitude;
  • production years;
  • operating cost estimates; and
  • other technical information.

Aircraft specifications may vary according to:

  • serial number;
  • configuration;
  • modification status;
  • engine option;
  • operating weight;
  • weather;
  • payload;
  • mission profile;
  • reserve requirements;
  • regulatory limitations;
  • manufacturer updates; and
  • operator procedures.

Accordingly, published specifications should be treated as general reference information unless expressly stated otherwise.

Users requiring technical information for an actual aircraft should consult the manufacturer, operator, approved aircraft documentation, or other authoritative source.

10. AIRCRAFT RANGE INFORMATION

Aircraft range figures are generally based on particular assumptions and operating conditions.

Actual achievable range may differ significantly depending on factors including:

  • payload;
  • number of passengers;
  • baggage;
  • winds;
  • temperature;
  • routing;
  • altitude;
  • airport elevation;
  • fuel reserves;
  • air traffic restrictions;
  • aircraft configuration;
  • operator policies; and
  • weather.

A range figure published by BizJet Journal does not constitute a guarantee that a particular city pair can be flown nonstop by a specific aircraft on a particular day.

11. AIRCRAFT DATABASE INFORMATION

BizJet Journal may operate an aircraft database or other aviation intelligence database containing information concerning aircraft.

Information may include:

  • registration;
  • manufacturer;
  • model;
  • serial number;
  • year of manufacture;
  • aircraft category;
  • registration country;
  • operator;
  • management company;
  • owner information where lawfully available;
  • base location;
  • aircraft photographs;
  • configuration;
  • specifications;
  • passenger capacity;
  • aircraft history;
  • status;
  • transaction history; and
  • related aviation information.

Such information may be compiled from multiple sources.

Although we may take reasonable measures to improve data quality, aviation databases constantly change.

Aircraft may:

  • change ownership;
  • change registration;
  • change operator;
  • move between jurisdictions;
  • be leased;
  • be sold;
  • be placed into storage;
  • undergo refurbishment;
  • change configuration;
  • be removed from service;
  • be exported;
  • be imported;
  • be deregistered; or
  • otherwise change status.

BizJet Journal therefore does not guarantee that every database entry is complete, current, or error-free.

12. AIRCRAFT OWNERSHIP AND OPERATOR INFORMATION

Aircraft ownership structures can be complex.

Aircraft may be legally registered to:

  • companies;
  • trusts;
  • leasing companies;
  • special-purpose entities;
  • financing entities;
  • management companies;
  • nominees;
  • operators; or
  • other legal structures.

A database record identifying an entity associated with an aircraft should therefore not automatically be interpreted as identifying the beneficial owner, passenger, user, or controlling individual of that aircraft.

Users should not draw unsupported conclusions from registration information alone.

13. AIRCRAFT TRACKING AND LOCATION INFORMATION

Where BizJet Journal displays or discusses aircraft movements, aircraft locations, flight histories, or tracking information, such information may originate from third-party or publicly available sources.

Tracking information may be:

  • delayed;
  • incomplete;
  • inaccurate;
  • blocked;
  • filtered;
  • unavailable; or
  • subject to technical limitations.

No representation is made that tracking information reflects an aircraft's exact real-time position unless expressly stated.

14. AIRPORT AND FBO INFORMATION

BizJet Journal may publish information concerning airports, private terminals, FBOs, ground handlers, parking, slots, operating hours, fuel availability, customs, immigration, hangars, facilities, and other airport-related services. Such information can change without notice.

Before operating to or arranging travel through an airport or FBO, users should independently confirm current operational requirements with the relevant airport, FBO, operator, regulator, or service provider.

15. CHARTER PRICE INFORMATION

BizJet Journal may publish:

  • estimated charter prices;
  • hourly rates;
  • route estimates;
  • average trip costs;
  • market pricing;
  • aircraft cost comparisons; or
  • historical charter pricing.

Unless expressly stated otherwise, such figures are estimates and should not be considered binding quotations.

Actual charter prices can vary according to numerous factors, including:

  • aircraft type;
  • aircraft location;
  • repositioning;
  • crew positioning;
  • airport fees;
  • landing fees;
  • parking;
  • handling;
  • fuel;
  • de-icing;
  • catering;
  • taxes;
  • international fees;
  • permits;
  • availability;
  • seasonality;
  • demand;
  • itinerary;
  • overnight costs;
  • crew expenses;
  • maintenance requirements;
  • geopolitical conditions; and

  • market conditions.

A published price should not be interpreted as a guarantee that an aircraft can be chartered at that price.

16. MARKET DATA AND INDUSTRY FORECASTS

BizJet Journal may publish market research, forecasts, estimates, market sizes, fleet analyses, transaction data, pricing trends, utilization figures, demand forecasts, traffic statistics, and other industry intelligence.

Such information may depend on:

  • third-party datasets;
  • sampling methods;
  • assumptions;
  • estimates;
  • methodologies;
  • incomplete information; or
  • historical data.

Forecasts and estimates inherently involve uncertainty.

Actual outcomes may differ materially from projections.

Users should independently assess information before making material commercial, financial, investment, acquisition, operational, or strategic decisions.

17. NO INVESTMENT OR FINANCIAL ADVICE

BizJet Journal may discuss:

  • aviation companies;
  • aircraft values;
  • manufacturers;
  • public companies;
  • mergers;
  • acquisitions;
  • investments;
  • aircraft financing;
  • aircraft transactions;
  • industry valuations;
  • market opportunities; or
  • economic trends.

Such content is for informational and journalistic purposes only.

Unless expressly stated otherwise, BizJet Journal does not provide:

  • investment advice;
  • securities advice;
  • financial planning;
  • tax advice;
  • accounting advice;
  • investment recommendations; or
  • fiduciary services.

Nothing published by BizJet Journal should be interpreted as a recommendation to buy, sell, finance, lease, or invest in any aircraft, company, security, asset, or financial product.

18. NO LEGAL OR REGULATORY ADVICE

BizJet Journal may publish information regarding aviation regulations, privacy regulations, customs requirements, sanctions, permits, aircraft registration, taxation, importation, aviation law, or other legal subjects.

Such content is provided for general information and does not constitute legal advice.

Users requiring advice concerning a specific legal or regulatory matter should consult an appropriately qualified professional or competent authority.

19. EDITORIAL ACCURACY

BizJet Journal aims to publish high-quality and reasonably accurate information.

However, news develops quickly and information available at the time of publication may later:

  • change;
  • become outdated;
  • be corrected;
  • be disputed;
  • prove incomplete; or
  • require clarification.

We do not guarantee that all information is complete, accurate, current, or suitable for every purpose.

20. CORRECTIONS AND UPDATES

BizJet Journal may correct, update, clarify, annotate, supplement, or remove content where appropriate.

Corrections may be made without altering the original publication date.

In appropriate cases, we may add:

  • corrections;
  • editor's notes;
  • update notices;
  • clarifications; or
  • other disclosures.

Requests for editorial corrections may be sent to:

editorial@bizjetjournal.com

Please include the URL of the relevant content and a clear explanation of the requested correction.

Submitting a correction request does not guarantee modification or removal.

21. EDITORIAL INDEPENDENCE

BizJet Journal retains editorial control over its publications.

We may decide:

  • what stories to cover;
  • what information to publish;
  • which sources to use;
  • whether to conduct an interview;
  • whether to publish a press release;
  • how a story is structured;
  • whether an article requires correction;
  • whether content should be updated; and
  • whether content should remain in our archives.

Advertisers, sponsors, partners, manufacturers, operators, or other commercial parties do not automatically receive editorial control merely because they have a commercial relationship with BizJet Journal.

22. OPINIONS AND COMMENTARY

BizJet Journal may publish commentary, analysis, guest articles, interviews, contributed articles, and opinion pieces.

Views expressed by:

  • contributors;
  • interviewees;
  • guest authors;
  • columnists;
  • commentators; or
  • quoted individuals

are their own unless expressly identified as representing BizJet Journal.

Publication of a viewpoint does not necessarily constitute endorsement by BizJet Journal.

23. INTELLECTUAL PROPERTY

Unless otherwise indicated, the Services and their contents are owned by, licensed to, or lawfully used by BizJet Journal.

24. LIMITED PERSONAL-USE LICENSE

Subject to these Terms, BizJet Journal grants you a limited, non-exclusive, non-transferable, revocable license to access and use publicly available content for lawful personal, educational, or internal business reference purposes.

This license does not transfer ownership of any intellectual property.

Except where permitted by applicable law or authorized in writing by BizJet Journal, you may not commercially exploit our content.

25. SHARING BIZJET JOURNAL ARTICLES

You may generally share links directing users to publicly accessible BizJet Journal articles.

You may also quote limited portions of articles where permitted by applicable law, provided that:

  • the quotation is reasonable in context;
  • BizJet Journal is clearly identified as the source;
  • the author's name is credited where appropriate;
  • the quotation is not misleadingly altered;
  • the quotation does not substitute for the original article; and
  • a link to the original article is provided where reasonably practicable.

This does not grant permission to reproduce entire or substantial portions of our content.

Nothing in these Terms is intended to restrict rights expressly granted by applicable copyright exceptions, limitations, fair dealing, fair use, quotation rights, or similar laws.

26. REPUBLICATION

You may not republish entire BizJet Journal articles, reports, databases, aircraft profiles, or substantial portions of them on another website, application, newsletter, publication, database, social media account, commercial platform, or service without prior written authorization.

This restriction applies even where attribution or a hyperlink is provided.

Permission for syndication, republication, or licensing may be requested at:

info@bizjetjournal.com

27. COMMERCIAL CONTENT LICENSING

Organizations interested in commercially using BizJet Journal content may be required to obtain a written licensing agreement.

  • data feeds;
  • API access;
  • content redistribution; or
  • enterprise use.

Separate fees and terms may apply.

28. SCRAPING AND AUTOMATED EXTRACTION

Except where expressly authorized by us in writing or required by applicable law, you may not use automated means to systematically access, collect, extract, copy, download, monitor, or reproduce information from the Services.

Prohibited technologies and methods may include:

  • web crawlers;
  • spiders;
  • scrapers;
  • bots;
  • headless browsers;
  • automated scripts;
  • extraction software;
  • browser automation;
  • data harvesting software; and
  • similar technologies.

This restriction applies particularly to systematic extraction of:

  • aircraft database records;
  • aircraft registrations;
  • fleet information;
  • operator data;
  • company directories;
  • airport databases;
  • FBO databases;
  • article archives;
  • market research;
  • pricing data;
  • proprietary classifications; or
  • other structured BizJet Journal information.

Normal indexing by legitimate public search engines may be permitted subject to our technical controls and policies.

29. ARTIFICIAL INTELLIGENCE AND MACHINE LEARNING

Except with prior written authorization from BizJet Journal or where a use cannot lawfully be restricted, you may not systematically use BizJet Journal content to:

  • train an artificial intelligence model;
  • train a machine-learning system;
  • fine-tune a language model;
  • create training datasets;

  • build embeddings databases;
  • develop retrieval datasets;
  • create synthetic datasets;
  • populate a competing knowledge base;
  • train recommendation models;
  • reproduce our database through automated extraction; or
  • develop commercial AI products substantially based on BizJet Journal content.

To the fullest extent permitted by applicable law, BizJet Journal expressly reserves applicable rights relating to automated text and data mining of its protected content.

Availability of content on a publicly accessible webpage does not by itself constitute permission for unrestricted automated harvesting, machine-learning training, or commercial dataset creation.

30. SEARCH ENGINES AND DISCOVERY SERVICES

Nothing in Section 28 or 29 is intended to prohibit ordinary search-engine indexing that:

  • directs users to BizJet Journal;
  • respects applicable technical restrictions;
  • does not reproduce substantial portions of our content; and
  • does not create a substitute for BizJet Journal's Services.

We reserve the right to modify crawler permissions, technical restrictions, metadata, robots directives, or other access controls.

31. ROBOTS.TXT AND TECHNICAL PERMISSIONS

Technical accessibility should not necessarily be interpreted as contractual permission.

A failure to block a particular automated tool through robots.txt, headers, rate limits, or another technical mechanism does not constitute an affirmative grant of rights beyond those expressly provided under these Terms or applicable law.

32. API AND DATA FEEDS

If BizJet Journal offers APIs, data feeds, enterprise database access, or other machine-readable services, access may be governed by additional terms.

You must not circumvent API limits by scraping the public website or using multiple accounts, proxies, or other methods designed to avoid restrictions.

33. DATABASE RIGHTS

Where applicable law recognizes legal protection for databases, database investments, collections, compilations, or substantial extraction, BizJet Journal reserves all such rights to the fullest extent permitted by law.

You may not repeatedly or systematically extract portions of a protected database in a manner that effectively reconstructs or substitutes for the original database.

34. TRADEMARKS

The names, logos, marks, branding, and visual identity associated with BizJet Journal may constitute trademarks, trade names, or other protected brand assets.

You may not use BizJet Journal branding in a way that:

  • suggests endorsement;
  • suggests sponsorship;
  • creates confusion;
  • impersonates BizJet Journal;
  • misrepresents an affiliation; or
  • infringes applicable rights.

All third-party company names, aircraft manufacturer names, aircraft model names, logos, and trademarks appearing on the Services remain the property of their respective owners where applicable.

References to third-party brands are generally made for identification, reporting, commentary, analysis, comparison, or other legitimate purposes.

35. NO IMPLIED AFFILIATION

Coverage of an aviation company, aircraft manufacturer, operator, broker, FBO, airport, executive, organization, or product does not imply that BizJet Journal:

  • represents that organization;
  • is owned by that organization;
  • is endorsed by that organization;
  • has a commercial relationship with that organization; or
  • is affiliated with that organization,

unless we expressly state otherwise.

36. LINKING TO BIZJET JOURNAL

You may generally link to publicly available BizJet Journal pages provided that the link:

  • is lawful;

  • does not appear in connection with unlawful or deceptive activity.

We reserve the right to request removal of links that are misleading, abusive, deceptive, or otherwise inappropriate.

  • documents;
  • feedback; or
  • other material.

You remain responsible for material you submit.

39. RIGHTS YOU GRANT FOR SUBMITTED MATERIAL

If you submit content to BizJet Journal for publication, editorial consideration, promotion, or public display, you grant BizJet Journal a worldwide, non-exclusive, royalty-free license to the extent necessary to:

  • review;
  • edit;
  • format;
  • reproduce;
  • publish;
  • distribute;
  • display;
  • archive;
  • promote;
  • syndicate where appropriate; and
  • otherwise use that material for the purpose for which it was submitted.

This license applies only to rights you are legally able to grant.

Different written arrangements may apply to commissioned contributors, photographers, agencies, licensors, or commercial partners.

40. WARRANTIES REGARDING SUBMISSIONS

By submitting material, you represent that, to the best of your knowledge:

  • you have the right to submit it;
  • publication will not knowingly violate another person's rights;
  • it is not unlawfully defamatory;
  • it does not unlawfully disclose confidential information;
  • it does not contain malicious software;
  • required permissions have been obtained where applicable; and
  • information you present as factual is not knowingly false or deceptive.

41. PRESS RELEASES AND MEDIA MATERIALS

If you or an authorized representative submit a press release, media kit, executive biography, photograph, company announcement, quote, event announcement, aircraft photograph, or similar media material with the intention that media organizations consider it for publication, you acknowledge that BizJet Journal may reasonably use that material for editorial reporting, subject to applicable rights and restrictions communicated to us.

Submission does not guarantee publication.

BizJet Journal may:

  • edit;
  • shorten;
  • fact-check;
  • contextualize;
  • decline;
  • delay;
  • update; or
  • independently report on

information contained in a submission.

42. INTERVIEWS

Participation in an interview with BizJet Journal does not guarantee publication.

Unless otherwise agreed before the interview, BizJet Journal may determine:

  • what portions of an interview are relevant;
  • how quotations are contextualized;
  • whether material is included;
  • how the final article is structured; and
  • when or whether the article is published.

Any specific agreement concerning:

  • off-the-record discussions;
  • background information;
  • embargoes;
  • quote approval;
  • anonymity; or
  • source confidentiality

should be agreed with the relevant BizJet Journal representative before the information is provided.

43. CONFIDENTIAL STORY TIPS AND SOURCES

Do not assume that information sent through a general contact form, advertising inbox, public social media message, or ordinary email is automatically confidential.

If you wish to communicate as a confidential journalistic source, you should clearly indicate this before disclosing highly sensitive information and seek confirmation from the relevant editor regarding the basis on which the communication will occur.

Nothing in these Terms is intended to waive any journalistic source protections that may otherwise apply.

44. USER COMMENTS

If commenting or community functionality is available, you must not post material that is:

  • unlawful;
  • threatening;
  • harassing;
  • deliberately defamatory;
  • fraudulent;
  • impersonating another person;
  • infringing;
  • malicious;
  • discriminatory in violation of applicable law;
  • spam;
  • advertising posted without permission;
  • designed to distribute malware; or
  • otherwise abusive.

We may moderate, restrict, remove, or disable comments at our discretion consistent with applicable law and our editorial standards.

45. ADVERTISING

BizJet Journal may display advertising from third parties.

The appearance of an advertisement does not necessarily mean BizJet Journal endorses:

  • the advertiser;
  • its products;
  • its services;
  • its claims; or
  • its business practices.

Advertisers are responsible for the claims made in their advertisements.

Users should independently evaluate commercial offers before entering into transactions.

46. SPONSORED CONTENT

BizJet Journal may publish sponsored, partner, commercial, branded, or advertiser-supported content.

Where appropriate, such content may be identified using labels such as:

  • Sponsored;
  • Partner Content;
  • Advertisement;
  • Presented By;
  • Brand Partner; or
  • another reasonably clear disclosure.

The specific label may vary depending on the format and nature of the commercial relationship.

47. EDITORIAL CONTENT AND COMMERCIAL RELATIONSHIPS

An advertiser's commercial relationship with BizJet Journal does not automatically entitle that advertiser to favorable editorial treatment.

Likewise, BizJet Journal may independently report on companies that advertise with, sponsor, or otherwise have a business relationship with us.

48. AFFILIATE LINKS

Some BizJet Journal content may include affiliate or referral links.

Where such arrangements exist, BizJet Journal may receive compensation if a user completes a transaction or other qualifying action through the relevant link.

Where required, appropriate disclosures will be provided.

The presence of an affiliate relationship does not eliminate the user's responsibility to independently evaluate the relevant product or service.

49. THIRD-PARTY LINKS

The Services may contain links to third-party websites, including:

Your use of third-party services is governed by the third party's own terms.

57. WEBSITE AVAILABILITY

We aim to keep BizJet Journal accessible, but uninterrupted availability cannot be guaranteed.

The Services may become unavailable because of:

We may modify, suspend, replace, or discontinue any part of the Services.

58. ARCHIVED CONTENT

BizJet Journal may maintain historical articles and archived information.

Archived content reflects the information and context available at the relevant time.

An older article should not necessarily be assumed to represent current:

  • regulations;
  • aircraft status;
  • company ownership;
  • management;
  • pricing;
  • technology;
  • market conditions; or
  • BizJet Journal editorial conclusions.

59. REMOVAL REQUESTS

The fact that an individual or company prefers that accurate historical information no longer appear online does not automatically create an obligation for BizJet Journal to remove it.

Requests to remove, de-index, anonymize, correct, or modify editorial material may be evaluated according to:

  • applicable law;
  • accuracy;
  • public interest;
  • journalistic value;
  • historical value;
  • privacy interests;
  • freedom of expression;
  • proportionality; and
  • other relevant considerations.

60. COPYRIGHT COMPLAINTS

If you believe material appearing on BizJet Journal infringes copyright that you own or are authorized to enforce, please contact:

info@bizjetjournal.com

Your notice should provide enough information for us to identify and evaluate the claim, including where appropriate:

  • identification of the protected work;
  • identification of the allegedly infringing material;
  • the relevant URL;
  • your contact information;
  • the basis on which you claim rights;
  • evidence of authorization if acting for another person; and
  • any other information reasonably necessary to assess the complaint.

Submitting a copyright complaint does not guarantee immediate removal.

We may request additional information before taking action.

61. PRIVACY

Our collection and processing of personal information in connection with the Services is described in our Privacy Policy.

Our use of cookies and similar technologies may also be described in a separate Cookie Policy or cookie preference tool.

By using the Services, you acknowledge that you have had the opportunity to review those notices.

62. WARRANTIES DISCLAIMER

To the fullest extent permitted by applicable law, the Services are provided on an "as available" and "as is" basis.

BizJet Journal does not warrant that:

  • aircraft data is always current;
  • market forecasts will prove correct;
  • every external link will remain available;
  • website access will be uninterrupted;
  • the Services will satisfy every user's requirements;
  • defects will always be corrected immediately; or
  • the Services will be free from every harmful technical element.

Nothing in this section excludes warranties or rights that cannot lawfully be excluded.

63. YOUR RESPONSIBILITY FOR DECISIONS

You remain responsible for decisions you make based on information obtained through BizJet Journal.

Before making significant decisions involving:

  • aircraft charter;
  • aircraft acquisition;
  • aircraft sale;
  • aircraft leasing;
  • investments;
  • flight operations;
  • aviation safety;
  • regulatory compliance;
  • financing;
  • legal matters;
  • taxes;
  • permits;
  • airport operations; or
  • other material commercial decisions,

you should independently verify relevant information and obtain appropriate professional advice where necessary.

64. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, BizJet Journal and its owners, directors, employees, contributors, contractors, licensors, affiliates, and representatives will not be liable for indirect, incidental, consequential, exemplary, punitive, or special damages arising from or connected with your use of the Services.

This may include losses arising from:

  • reliance on inaccurate information;
  • lost profits;
  • lost revenue;
  • loss of business opportunities;
  • loss of data;
  • business interruption;
  • decisions based on market estimates;
  • third-party services;
  • unavailable content; or
  • unauthorized use of the Services.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

65. THIRD-PARTY INFORMATION

A significant portion of aviation reporting necessarily concerns or relies on information originating from third parties.

BizJet Journal does not assume responsibility for every error originating from:

  • public databases;
  • government records;
  • regulatory databases;
  • manufacturers;
  • aircraft registries;
  • operators;
  • airports;
  • FBOs;
  • press releases;
  • interviewees;
  • industry databases;
  • research providers; or
  • other external sources.

Where material inaccuracies are identified, we may evaluate whether correction is appropriate.

66. INDEMNIFICATION

To the extent permitted by applicable law, if your unlawful conduct, material breach of these Terms, or infringement of another person's rights causes a third-party claim against BizJet Journal, you agree to be responsible for resulting losses, liabilities, damages, costs, and reasonable expenses to the extent legally attributable to your conduct.

This provision does not apply where prohibited by mandatory consumer law.

67. CONSUMER RIGHTS

Nothing in these Terms is intended to exclude or restrict mandatory rights that applicable consumer protection law does not permit businesses to exclude.

If a provision of these Terms conflicts with a non-waivable consumer right that applies to you, the mandatory legal protection will prevail to the extent of the conflict.

68. INTERNATIONAL USERS

BizJet Journal serves a global audience.

The fact that content is accessible in a particular country does not mean that:

  • every service is legally available there;
  • every statement is adapted to local regulations;
  • BizJet Journal has an establishment in that jurisdiction; or
  • local aviation rules are reflected in every article.

You are responsible for complying with laws applicable to your own use of the Services.

69. GOVERNING LAW

Subject to mandatory rights that may apply under another jurisdiction's laws, these Terms and disputes arising from them will be governed by the laws of:

Kenya

without regard to conflict-of-laws principles to the extent legally permissible.

This section should be completed based on the jurisdiction of the legal entity operating BizJet Journal.

70. JURISDICTION AND DISPUTES

Subject to any mandatory legal rights applicable to you, disputes arising from or relating to these Terms or the Services will be subject to the jurisdiction of the competent courts of:

Kenya

unless BizJet Journal and the relevant party agree in writing to another lawful dispute-resolution procedure.

Nothing in this clause prevents either party from seeking urgent interim or injunctive relief from a competent court where legally available.

71. NO WAIVER

If BizJet Journal does not immediately enforce a provision of these Terms, that does not mean we permanently waive the right to enforce it.

Any waiver must be legally effective under applicable law.

72. SEVERABILITY

If a court or competent authority determines that a provision of these Terms is invalid, unlawful, or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

Where possible, an invalid provision should be interpreted or modified to reflect its intended purpose while remaining lawful.

73. ASSIGNMENT

You may not transfer your rights or obligations under these Terms where doing so would materially affect BizJet Journal without our prior consent.

BizJet Journal may transfer rights or obligations associated with the Services in connection with:

  • restructuring;
  • incorporation;
  • merger;
  • acquisition;
  • asset transfer;
  • financing;
  • reorganization; or
  • transfer of the BizJet Journal business,

subject to applicable law.

Your use of BizJet Journal does not create:

  • a partnership;
  • joint venture;
  • employment relationship;
  • agency relationship;
  • fiduciary relationship;
  • brokerage relationship; or
  • professional-client relationship

between you and BizJet Journal.

They do not independently alter the meaning of these Terms.

77. LANGUAGE

These Terms may be made available in languages other than English.

Unless prohibited by applicable law, where a translation differs materially from the English version, the English-language version will govern.

78. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy, Cookie Policy, and any additional terms expressly applicable to a specific BizJet Journal product or service, form the agreement governing your use of the relevant Services.

A separate written commercial agreement may override these Terms for matters specifically covered by that agreement.

Provisions that by their nature should continue after termination or cessation of use will survive, including provisions concerning:
